Mojo Gift Terms and Conditions for Recipients

 

1. Acceptance of Terms 

1.1 By redeeming a Mojo Gift experience, you agree to be bound by these terms and conditions. 

1.2 If you do not agree, please contact us for clarification before proceeding with your booking.

 

2. Redeeming Your Gift 

2.1 To redeem your Mojo Gift, visit our website and enter your gift card number. 

2.2 You will need to create an account or log in if you already have one. 

2.3 Once redeemed, your experience options will appear in your account’s gift card section. You can then book or exchange for another available experience.

 

3. Experience Availability 

3.1 Mojo Gift offers a selection of experiences, but availability is subject to the activity supplier. 

3.2 We cannot guarantee the availability of any specific experience at any given time. 

3.3 If an experience is unavailable, you may choose another from the available options. Mojo Gift is not obligated to return funds or provide a cash refund if an experience cannot be booked.

 

4. Booking Your Experience 

4.1 All bookings are subject to the availability and terms of the specific activity supplier. 

4.2 Bookings should be made at least 14 days in advance to ensure availability. 

4.3 Once a date is confirmed with the activity supplier, changes or cancellations are subject to the supplier’s terms and conditions. 

4.4 A reservation is only final and confirmed once you receive a written confirmation from our Reservations team. A reservation on our website does not mean the booking is confirmed. 

4.5 If a reservation cannot be confirmed, we will unlock the gift card to be used for another experience. We will not refund any kind of monetary value.

 

5. Cancellations and Rescheduling 

5.1 Cancellations or rescheduling must be done at least 48 hours before the booked date unless otherwise specified by the supplier. 

5.2 If you fail to cancel within the required timeframe, the value of the gift card may be forfeited. Additionally, even if you cancel within the required timeframe, we cannot guarantee that the cancellation will be free of charge. Some providers may charge the full amount for the experience, which will result in the gift card’s value being reduced to zero, and we will inform you accordingly. 

5.3 In case of cancellations by the supplier due to weather or other unforeseen circumstances, you should rebook directly with the supplier.

 

6. Refunds and Exchanges 

6.1 If you are not satisfied with your gift, contact us to explore alternative experiences or products. 

6.2 We do not offer refunds.

 

7. Validity 

7.1 Mojo Gift cards do not have an expiry date. 

7.2 The original gift card must be presented when redeeming an experience. 

7.3 We are not liable for lost gift cards. If you cannot provide your gift card number, you will lose access to your gift card.

 

8. Products and Goods 

8.1 For physical products, the warranty and terms of service from the seller apply. 

8.2 Mojo Gift does not guarantee the delivery of goods and is not liable for defects, incorrect products, or any other issues with the product received. 

8.3 Any claims regarding the product should be directed to the seller in accordance with their terms and conditions.

 

9. Liability and Insurance 

9.1 Mojo Gift acts as a booking intermediary and is not responsible for the quality or safety standards of the experiences provided by third-party suppliers. 

9.2 Participants are advised to check with the supplier regarding any insurance coverage and to consider obtaining their own insurance for high-risk activities. 

9.3 Mojo Gift is not liable for any damages, injuries, loss, or any kind of damage before, during, or after an experience. Mojo Gift is not a provider of these experiences and is therefore not liable in any way.

 

10. Restrictions 

10.1 Some activities have specific restrictions (age, weight, health conditions). Please review these before booking to ensure eligibility. 

10.2 It is the recipient’s responsibility to comply with any restrictions or requirements stated by the activity supplier.

 

11. Privacy and Data Protection 

11.1 Your personal data will be handled according to our Privacy Policy, which complies with GDPR regulations. 

11.2 We do not share your personal information with third parties except as required to complete your booking or as stated in our Privacy Policy.

 

12. Incorrect Information 

12.1 While we strive to ensure that all information on our website is accurate, errors may occasionally occur. 

12.2 Mojo Gift is not liable for any incorrect or incomplete information on our website. 

12.3 If you find an error, please contact us so we can correct it as soon as possible.

 

13. Gift Card Transferability

13.1 Received Mojo Gift cards are not tied to an account, name, IP address, or email. 

13.2 Recipients are free to give their Mojo Gift card to someone else without any fee. 

13.3 However, we are unable to change any personal messages attached to the gift card.

 

14. Final Provisions 

13.1 These terms and conditions are subject to change without prior notice. Continued use of our services implies acceptance of any revised terms.

 

14. Governing Law and Dispute Resolution 

14.1 These terms and conditions are governed by the laws of the Netherlands. 

14.2 Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
